Distance Selling Agreement

DISTANCE SELLING AGREEMENT

Seller: Old Bazaar General Trading LLC (“Seller”)

Buyer: The customer placing an order on the Platform (“Buyer”)

1. Purpose

This Agreement governs the sale of products through remote communication channels (online purchase) and sets out the rights and obligations of the Seller and Buyer.

2. Formation of Contract

A legally binding contract is formed when:

  1. Buyer places an order through the Platform, and

  2. Payment is successfully authorized/confirmed, and

  3. Seller issues an order confirmation (email/notification).

The Seller may refuse or cancel an order in accordance with the Terms & Conditions (e.g., suspected fraud, pricing errors, stock unavailability).

3. Product Information

Buyer acknowledges that:

  • Product details, quantity, and pricing are presented prior to checkout

  • Prices are in AED and include VAT unless stated otherwise

  • Availability may vary and some items may be substituted or refunded if unavailable

4. Delivery Terms

Delivery terms are governed by the Delivery Policy published on the Platform.

Delivery times are estimates and not guaranteed.
Risk transfers to the Buyer upon successful delivery completion.

5. Cancellation

Buyer may request cancellation within 30 minutes of placing the order, provided the order has not been processed or dispatched.

If the order has been processed/dispatched, cancellation is subject to the Refund Policy and operational feasibility.

6. Returns & Refunds

Refunds and resolutions are governed by the Refund Policy published on the Platform.

Refunds are processed only to the original method of payment.

7. Perishable Goods

Buyer acknowledges that some products are perishable (fresh, chilled, frozen).
Once delivery is completed, the Buyer is responsible for appropriate storage and handling.

Claims for quality issues must follow the timelines stated in the Refund Policy.

8. Limitation of Liability

To the maximum extent permitted by UAE law, Seller’s total liability shall not exceed the total order value paid by the Buyer for the relevant order.

9. Governing Law & Jurisdiction

This Agreement is governed by the laws of the United Arab Emirates.
Any disputes shall be subject to the exclusive jurisdiction of the Dubai Courts.
